It is the second time this century women have won a significant human right. Readers may have missed it with the headlines being dominated with the <a href=\"http:\/\/www.independent.co.uk\/news\/uk\/politics\/jeremy-corbyn-ben-bradley-tory-mp-apology-spy-tweet-donation-homeless-charity-false-foodbank-labour-a8226661.html\" target=\"_blank\" rel=\"noopener\">Corbyn Spy lie<\/a>. The dominance of the spy lie is an example of how women are part of structural exclusion and discrimination. The <a href=\"http:\/\/www.bbc.co.uk\/news\/uk-39249469\" target=\"_blank\" rel=\"noopener\">Worboys case<\/a> itself is another. It shows how sexual violence is not unconnected to state violence and how deeply sexism is entrenched in our institutions. So, women are continually fighting for <a href=\"http:\/\/www.un.org\/en\/universal-declaration-human-rights\/index.html\" target=\"_blank\" rel=\"noopener\">human rights<\/a>. The Met v DSD is just another step in women\u2019s quest for human rights. But <a href=\"https:\/\/en.wikipedia.org\/wiki\/Theresa_May\" target=\"_blank\" rel=\"noopener\">Theresa May<\/a> is leading the way to have it all undone.<\/p>\n<h2>The Spoils of War<\/h2>\n<p>Military forces of all colours, see the raping of women as the spoils of war. The Red Army \u2018<a href=\"https:\/\/www.amazon.co.uk\/Berlin-Downfall-1945-Antony-Beevor\/dp\/0141032391\" target=\"_blank\" rel=\"noopener\">Raped every German female from eight to eighty<\/a>\u2019 (1945). In Rwanda, soldiers raped an estimated 250 thousand women and children during the civil war (1990\/94). Rape was a mere violation of the customs of war although since 1447 it has been a <a href=\"http:\/\/www.womensmediacenter.com\/women-under-siege\/when-rape-became-a-war-crime-hint-its-not-when-you-think1\" target=\"_blank\" rel=\"noopener\">war crime<\/a>. Nonetheless, rape has been a feature of warfare that was largely ignored.<\/p>\n<p>But in 2001 the <a href=\"https:\/\/en.wikipedia.org\/wiki\/Hague_Tribunal\" target=\"_blank\" rel=\"noopener\">Hague Tribunal<\/a> elevated systematic rape to a crime against humanity. So, it gave women human rights that they had otherwise been denied. Convictions for rape as a war crime followed (see video below).<\/p>\n<h2>Human Rights &amp; The Met<\/h2>\n<p>However, women still have to fight for the human right to live free of violence. In Britain on average <a href=\"https:\/\/www.womensaid.org.uk\/information-support\/what-is-domestic-abuse\/how-common-is-domestic-abuse\/\" target=\"_blank\" rel=\"noopener\">two women are killed<\/a> by their partner, ex-partner or family every week. For women of colour, abuse can also include <a href=\"http:\/\/imjussayin.com\/blog\/fgm-the-bloody-controlling-of-womens-sexuality\/\" target=\"_blank\" rel=\"noopener\">FGM<\/a>, and \u2018<a href=\"http:\/\/www.independent.co.uk\/news\/uk\/home-news\/honour-killing-latest-rape-victim-wedding-day-term-a7559971.html\" target=\"_blank\" rel=\"noopener\">honour killings<\/a>\u2019 amongst others. Daily, women also face sexual violence.<\/p>\n<p>Misogyny allows rape to be treated as a second-rate offence. Therefore, rapists escape with light sentences, if they are convicted at all. Only <a href=\"https:\/\/www.theguardian.com\/society\/2016\/oct\/13\/reported-rapes-in-england-and-wales-double-in-five-years\" target=\"_blank\" rel=\"noopener\">7% of rapists (2,689) were convicted<\/a> despite 23,851 people, the vast majority of them women, suffering the trauma of rape.<\/p>\n<p>Our patriarchal society means that women are not <a href=\"http:\/\/imjussayin.com\/blog\/women-why-dont-we-believe-them\/\" target=\"_blank\" rel=\"noopener\">believed<\/a>. The Met Police did not believe two women <a href=\"http:\/\/www.bbc.co.uk\/news\/uk-39249469\" target=\"_blank\" rel=\"noopener\">raped by Worboys<\/a>. The Met <a href=\"http:\/\/webarchive.nationalarchives.gov.uk\/20100824164148\/http:\/\/www.ipcc.gov.uk\/news\/pr200110_worboys-2.htm\" target=\"_blank\" rel=\"noopener\">did not investigate<\/a> allegations for five years. So, Worboys continued to prey on women. The Police believe he may have attacked more than 100 women.<\/p>\n<p>And so, two victims challenged the police in the Met v DSD. The Met admitted their mistakes. Yet, the Met and the Home Office appealed against the\u00a0<a href=\"https:\/\/www.judiciary.gov.uk\/wp-content\/uploads\/JCO\/Documents\/Judgments\/dsd-and-nbv-v-met-police.pdf\" target=\"_blank\" rel=\"noopener\">High Court\u2019s ruling<\/a>. It established that under the Human Rights Act the police have a duty to investigate allegations of serious assault. And human rights laws also protect the individual from unlawful state action.<\/p>\n<p>The Met and the government appealed the decision three times. Despite the fact that meant taking away the right of victims to get a remedy for police failings. Nor is the landmark judgment perfect, the court awarded <a href=\"https:\/\/www.theguardian.com\/uk-news\/2014\/jul\/23\/john-worboys-victims-met-police-compensation\" target=\"_blank\" rel=\"noopener\">paltry\u00a0compensation<\/a>. \u00a0But the judgment has serious repercussions for the police and justice system.<\/p>\n<p>All our all justice institutions, <a href=\"https:\/\/www.theguardian.com\/uk-news\/2018\/jan\/05\/how-the-establishment-failed-victims-of-black-cab-rapist-john-worboys\" target=\"_blank\" rel=\"noopener\">systematically let women down<\/a>. The evidence shows that violence against women has a poor detection, prosecution and conviction rate. But the Met v DSD makes clear the State has a responsibility to have effective laws on rape and sexual violence which can be enforced. It gives women (and other vulnerable groups) a right to equal protection.<\/p>\n<p>In the wider context, it may help to eliminate society\u2019s victim-blaming attitude around cases of sexual violence.<\/p>\n<p>The UK does not have <a href=\"https:\/\/www.theguardian.com\/inequality\/2017\/oct\/11\/uk-no-further-forward-on-tackling-gender-inequality-eu-league-table-shows\" target=\"_blank\" rel=\"noopener\">gender equality<\/a> and <a href=\"https:\/\/www.fawcettsociety.org.uk\/Handlers\/Download.ashx?IDMF=e473a103-28c1-4a6c-aa43-5099d34c0116\" target=\"_blank\" rel=\"noopener\">Brexit threatens<\/a> its advance. We are also failing on <a href=\"https:\/\/www.theguardian.com\/law\/2016\/sep\/22\/uk-failing-on-many-human-rights-measures-report-claims\" target=\"_blank\" rel=\"noopener\">human rights<\/a> for women.  Issues include  <a href=\"https:\/\/news.sky.com\/story\/un-accuses-uk-of-violating-human-rights-over-ni-abortion-laws-11263896\" target=\"_blank\" rel=\"noopener\">reproductive health<\/a> and <a href=\"https:\/\/www.theguardian.com\/uk-news\/2017\/jul\/27\/kenyan-asylum-seeker-human-rights-yarls-wood-punishment-room\" target=\"_blank\" rel=\"noopener\">detention<\/a>.<\/p>\n<p>The future of women\u2019s human rights is at stake <a href=\"https:\/\/www.globalfundforwomen.org\/securing-lasting-wins-for-womens-rights\/#.WpL5yGacaF0\" target=\"_blank\" rel=\"noopener\">globally<\/a> and at home. Theresa May wants to <a href=\"https:\/\/www.theguardian.com\/commentisfree\/2017\/jun\/07\/theresa-may-human-rights-european-charter-terrorists\" target=\"_blank\" rel=\"noopener\">rip up the Human Rights<\/a> Act. In the Met v DSD it was May then Amber Rudd who made submissions as home secretaries in support of the police appeals.
